When should the “Three Guarantees” be counted?

In the national “Three Guarantees” regulation, the after-sales service calculation time is based on the purchase invoice time, but due to the delivery time is usually delayed by several days, consumers actually see and use the product more often than the purchase time. That is to say, the time for consumers to truly enjoy the “Three Guarantees” service will usually be shortened, and thus consumer disputes will continue to occur.

Delayed delivery, shortened “three packs” time plagued consumers

Not long ago, Mr. Yang, a Beijing consumer, complained that the desktop computer he had just bought had only been used for 12 days. He had a return time of 15 days, and factory maintenance personnel said that he could only repair it. Originally, Mr. Yang bought the computer on May 20. On May 23, the manufacturer delivered home and gave installation. He never thought that on June 5th, the computer's 19-inch LCD screen switch malfunctioned, and Mr. Yang thought Replace a monitor. However, after the manufacturer's maintenance personnel came to the door, they said that the return time is based on the invoice, not the delivery and installation time.

For this reason, Mr. Yang is very depressed: Before delivery and installation, he simply did not see the goods. How could he even use it? Besides, the delay in delivery is also the reason for manufacturers. How should it be up to him to take responsibility? But no matter how Mr. Yang excuse, manufacturers are not to change.

After receiving the complaint from Mr. Yang, the reporter contacted the manufacturer and learned that what Mr. Yang said was true. Finally, through the reporter's work, the manufacturer replaced the display screen for Mr. Yang.

Like Mr. Yang’s experience, the LCD TVs purchased by Mr. Wang, a consumer in Taiyuan City, just sent home to return the goods. Mr. Wang said that on April 20, a home appliance store in Taiyuan was engaged in activities. The original LCD TV sales price of 12,000 yuan was only 8,800 yuan. Without thinking about it, Mr. Wang immediately purchased it in full. As the home has not been renovated, he agreed to the delivery and installation on May 1st. Unexpectedly, Mr. Wang’s moving date was postponed to May 8. Therefore, the new TV was not delivered to the home until May 8. When Mr. Wang was excited to turn on the TV, he noticed that there was an obvious "bad point" in the lower right corner of the screen. Factory maintenance personnel also admitted that it was a product failure, but since the purchase time has exceeded 15 days, it cannot be returned and only free repairs can be provided.

Manufacturer: "Three Guarantees" time based on purchase invoice

Article 8 of the State “Three Guarantees” stipulates that “Three Guarantees” shall be valid from the date of issuing the invoice, and consumers shall complete repairs, exchange of goods, and returns within the validity period of “Three Guarantees” with invoices and “three guarantees”; Provisions: Product performance failure within 7 days from the date of sale, consumers can choose to return, exchange or repair; Article 10 provides: Product performance failure within 15 days from the date of sale, consumers can choose to change Goods or repairs. From this point of view, the manufacturer's after-sales service calculation time is based on the purchase invoice and it is not illegal. At the same time, a survey by the reporter found that all manufacturers deal with the return of the consumer, they are based on the invoice, regardless of delivery delays installed time.
